1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website, services, and communications provided by Meadowlark Log Homes, Inc., located at 50 Meadowlark Lane, Libby, MT 59923 (“Meadowlark Log Homes,” “we,” “us”). By using our site, submitting a form, requesting a floor plan or consultation, providing your phone number, or engaging us for products or services, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years old and authorized to enter into legal agreements. By using our services, you represent that you meet these requirements.

3. Electronic Communications, SMS & TCPA Consent

By providing your phone number to Meadowlark Log Homes through any channel — including web forms, consultation requests, calls, SMS, email, in-person at our facility, or third-party platforms — you represent and warrant that you are the account holder, subscriber, or customary user of the phone number provided, and you expressly authorize Meadowlark Log Homes and its direct agents to contact you at that number using:

  • Live agents, automated telephone dialing systems (ATDS), artificial or prerecorded voice messages, or automated texting systems;
  • SMS and MMS text messages sent using automated technology;
  • Email and any other electronic communication method;

This is for all marketing, sales, promotional, transactional, service-related, project updates, and informational purposes (including but not limited to floor plan inquiries, cabin kit details, and delivery schedules). This consent applies even if your number is currently listed on any federal, state, local, or internal Do-Not-Call (DNC) registry.

Consent is not required as a condition to purchase any log home packages, cabins, kits, or services from Meadowlark Log Homes. Message frequency varies based on your interactions with us. Standard message and data rates from your wireless carrier may apply.

Opt-out: You may revoke your consent to receive automated marketing communications at any time. To unsubscribe from text messages, reply STOP to any marketing text message received, or reply HELP for assistance. You may also submit opt-out requests via email to info@meadowlarkloghomes.com or by calling 800-850-8554. We process opt-out requests promptly, typically within 24 to 48 hours, and in no case later than the maximum period allowed by applicable law.

You agree that any consent you provide here serves as your “prior express written consent” under 47 U.S.C. § 227 and 47 C.F.R. § 64.1200 of the Telephone Consumer Protection Act (TCPA), and as consent under analogous state telemarketing laws (including, where applicable, the Florida Telephone Solicitation Act, Oklahoma Telephone Solicitation Act, and Washington Commercial Electronic Mail Act).

Call recording: Calls between you and Meadowlark Log Homes may be monitored or recorded for training, quality assurance, and compliance purposes. By continuing any telephonic conversation with us, you consent to such monitoring and recording where permitted by law.

4. Products and Services

Our architectural design or engineering services, log home packages, cabins, prefab kits, assembly and re-assembly, shipping services, and other related build services are governed by separate, explicitly executed purchase orders, manufacturing contracts, or written agreements. To the extent of any conflict, the separate executed agreement controls. Unless explicitly provided in writing in a finalized construction or supply contract, all structural calculations, shipping timelines, and construction steps are directional guides, and final engineering or local code compliance remains the buyer’s ultimate responsibility.

5. Acceptable Use

You may not use our website or services to (a) violate any law or third-party rights; (b) submit false, inaccurate, or misleading information, or impersonate others; (c) interfere with the security or operation of the site; (d) scrape, reverse engineer, or republish our architectural blueprints, floor plans, or website content without express written permission; or (e) submit phone numbers, contact information, or consent on behalf of someone else without proper authorization.

6. Intellectual Property

All content on this website — including architectural floor plans, designs, photographs of log homes, text, graphics, logos, video, software, and data compilations — is owned exclusively by Meadowlark Log Homes or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws. Downloading or viewing floor plans does not grant you a license to construct or replicate our unique designs without a separate commercial purchase agreement.

7. Disclaimers

The website, informational pricing, material estimators, and all content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Wood is a natural material subject to variations in grain, color, checking (cracking), and shifting; descriptions or pictures on this site are illustrative only. Meadowlark Log Homes does not warrant that the site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, Meadowlark Log Homes and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, or construction delays, arising from your use of the website or digital planning tools. Our total aggregate liability for any claim related specifically to your use of this website shall not exceed one hundred U.S. dollars ($100). Liability arising under a separate, executed Log Home Purchase and Sales Agreement is strictly governed by that specific contract.

9. Indemnification

You agree to defend, indemnify, and hold harmless Meadowlark Log Homes from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the site or site materials; (b) your violation of these Terms or applicable law; (c) your unauthorized use or distribution of our proprietary floor plans; or (d) any phone number, contact information, or consent you submitted without proper authority, including any third-party claims under the TCPA arising from a wrong, mistyped, or reassigned phone number.

10. Governing Law & Venue

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-law principles. Exclusive venue for any dispute arising under these Terms lies in the state or federal courts overseeing Lincoln County, Montana, and you consent to personal jurisdiction there.

11. Dispute Resolution & Class-Action Waiver

Except where prohibited by law, any dispute arising out of or relating to these Terms or website use shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You and Meadowlark Log Homes waive any right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. You may opt out of this arbitration agreement by notifying us in writing within 30 days of first agreeing to these Terms.

12. Changes to These Terms

We may modify these Terms at any time by posting the revised version on this page. Changes are effective when posted. Continued use of the site after the effective date constitutes acceptance of the updated Terms.
